10. Use of Artificial Intelligence and Machine Learning (AI/ML)

Our website may use AI and machine learning to help match you with Medicare plans that may fit your needs. These systems look at the information you provide and compare it with available plan data to generate recommendations. While we aim for accuracy, these recommendations are based on data and statistical models, they are not medical, legal, or financial advice. They are not a replacement for guidance from a licensed insurance agent, and no recommendation generated by our system should be treated as a final answer about your coverage needs or eligibility.

11. Communication Preferences and Consent

By using our service, you agree to receive communications from One & Done Smart Bids and the licensed agents helping with your Medicare plan selection. You can manage your communication preferences at any time through your My Account settings or by contacting us directly. There are two types of communications you may receive:

  • Transactional communications — such as enrollment confirmations, billing notices, and service updates. These may continue even if you opt out of marketing.
  • Marketing communications — such as new plan offerings and One & Done Smart Bids announcements. You may opt out of these at any time without affecting your enrollment or service rights.

Opting out of all communications may limit the ability of One & Done Smart Bids or your assigned agent to provide timely plan help, but will not affect any rights you have under the law.

This product uses publicly available data from the U.S. National Library of Medicine (NLM), National Institutes of Health, and the Centers for Medicare & Medicaid Services (CMS), and connects to the Blue Button APIs. NLM, CMS, and the U.S. Department of Health and Human Services do not endorse, certify, or recommend this or any other product.

13. Payments and Billing

If you make a purchase through our website, payments are processed securely by Stripe, Inc., our third-party payment processor. We do not store or have direct access to your full payment card information. By submitting payment details, you authorize Stripe to process your transaction under Stripe's Privacy Policy, available at https://stripe.com/privacy.

You agree to provide accurate billing information and authorize us (through Stripe) to charge your payment method for any fees or services you select.

14. Subscriptions and Recurring Charges

You may cancel your subscription at any time in accordance with our Cancellation Policy. Charges already billed before cancellation are non-refundable unless our Cancellation Policy states otherwise.

15. Refunds and Disputes

All refund requests are subject to our Cancellation Policy. Any disputes about charges may be submitted through Stripe's dispute process. We reserve the right to suspend or terminate your access if a chargeback or payment dispute is filed.

16. Third-Party Payment Processing

Payments are processed by Stripe, a third-party provider. We are not responsible for errors, delays, or security issues that occur on Stripe's end, but we will work with you and Stripe to resolve problems as best we can.

17. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the State of Delaware. Any legal action related to your use of our website or services must be filed in the state or federal courts in Delaware, and you agree to this jurisdiction.

Before filing any formal legal claim, both parties agree to first try to resolve the issue informally by contacting One & Done Smart Bids directly. If the dispute is not resolved within 30 days, either party may pursue formal legal action. Nothing in this section prevents either party from seeking emergency court relief to prevent serious or irreparable harm.

18. Business Transfers

If One & Done Smart Bids is involved in a merger, acquisition, sale, or similar business transaction, your personal and health information may be transferred as part of that deal, as permitted by law.

If such a transaction would significantly change how your information is handled, we will notify you and provide any rights required by law before those changes take effect.
